Which statement is true when you are overtaken in this situation?
The car that is overtaking you is in the wrong, because the driver is crossing a continuous centre line. In traffic, however, we do not have any rights, only obligations. In the Road Traffic Ordinance, it says:
“When a driver travelling on a road becomes aware that another driver intends to overtake them on the left-hand side, the driver shall [...] keep as far to the right as possible. The driver may not increase their speed or in any other way make it harder for the overtaking to be completed.”
This applies in all situations, even if the person overtaking you is performing a manoeuvre that is forbidden. The reason for this is to ensure increased safety in traffic.
