You have stopped temporarily at the side of the road. Which statement is true when you want to rejoin the road?

  • Incorrect: Road-users behind me have an obligation to give way, because I will be pulling out from the right.
  • Correct: I may only drive on when I am able to do so without causing any hazard or unnecessary obstruction to other road-users.
  • Incorrect: Because I will be changing lanes, road-users behind me have an obligation to adapt their speed to make it easier for me to rejoin the road.

In this example, this rule applies to you:

A driver may only start from the side of the road [...] if it is possible to do so without causing a hazard or an obstruction to other road-users.” (Road Traffic Ordinance)

The priority-to-the-right rule does not apply when your car is stationary at the side of the road. Neither is this classed as a changing of lanes, because the side of the road is not a lane. You will be ‘starting from the side of the road’, and must therefore comply with the legal text above.
